Synopsis - Course Overview

An oral fluid specimen collector is a person who instructs and assists employees at a collection site, who receives and makes an initial inspection of the oral fluid (saliva) specimen provided by those employees, and who initiates and completes the Chain of Custody Form. The oral fluid (saliva) collector has direct, face to face contact with the employee/subject. Without the collector ensuring the integrity of the oral fluid specimen and collection process, the test itself may lose credibility.

 

Under the US Department of Transportation (DOT) regulations, an individual performing oral fluid specimen collections must receive Qualification Training.

Complete the DOT required procedural training online. Once your procedural collector training is completed the DOT requires completion of five observed error-free mock collections under various scenarios. Transmetron’s course will satisfy the DOT training requirement for DOT Oral Fluid Specimen Collectors to perform the oral fluid collection for DOT drug testing programs. Our course is composed of two parts as required by the DOT; the “Qualification” training (including "Basic Information") and “Proficiency Demonstration”. This course may be used for Initial Training or the 5 Year Recertification training requirements (refresher training).

 

Proficiency Demonstration

 

The second part of the course will satisfy the DOT requirement for proficiency demonstration and must be completed within 30 days of completing the “Qualification” training. This course may be used for Initial Training or the 5 Year Recertification “Proficiency Demonstration” requirement.

This course satisfies the DOT requirements when error correction training is required. Sometimes called "remediation training", error correction training is required in the event the collector causes a fatal flaw that results in cancellation of the drug test. The Lab/MRO will notify the collector if this is necessary. This course is provided as a live Zoom / Skype Conference with Transmetron’s qualified staff. U.S. Department of Health and Human Services has established scientific and technical guidelines for the inclusion of oral fluid specimens.

U.S. Department of Health and Human Services created the Oral Fluids Mandatory Guidelines by providing DOT-regulated employers with the option of collecting an oral fluid specimen in lieu of a urine specimen when testing for drugs as required by the DOT drug testing regulations.

The U.S. Department of Transportation is proposing to amend the transportation industry drug testing program procedures regulation to include oral fluid testing. This will give employers a choice that will help combat employee cheating on urine drug tests and provide a more economical, less intrusive means of achieving the safety goals of the program. The proposal includes other provisions to update the Department's regulation, and to harmonize, as needed, with the new Mandatory Guidelines for Federal Workplace Drug Testing Programs using Oral Fluid established by the U.S. Department of Health and Human Services.

Effective January 1, 2020, the OFMG allowed the option to use oral fluid specimens for Federal drug testing. As described in the OFMG rulemaking, the advantage of every oral fluid collection is that it will be directly observed, as opposed to most urine collections, which are unobserved. While directly observed urine specimen collections have long been the most effective method for preventing individuals from cheating on their drug tests by substituting or adulterating their specimens, directly observed urine collection may only be done in certain circumstances due to employee privacy concerns (see 49 CFR 40.67). Unlike directly observed urine collections, an oral fluid collection is much less intrusive on the tested employee's privacy. By providing the option of collecting an oral fluid specimen, DOT is broadening options for the testing of safety-sensitive employees in the transportation industries. As discussed below, oral fluid collection can also reduce costs of compliance with Part 40.

   

The Substance Ause and Mental Health Services Administration (SAMHSA), part the U.S. Dept. of Health and Humans Services (HHS), has established scientific and technical guidelines for the inclusion of oral fluid specimens in the Mandatory Guidelines for Federal Workplace Drug Testing Programs.

The Mandatory Guidelines for Federal Workplace Drug Testing Programs using Oral Fluid (OFMG) will allow federal executive branch agencies to collect and test an oral fluid specimen as part of their drug testing programs. In addition, these Guidelines may also be used by some agencies, such as the Department of Transportation and Nuclear Regulatory Commission (NRC), as part of their regulated drug testing programs. The OFMG establish standards and technical requirements for oral fluid collection devices, initial oral fluid drug test specimens and methods, confirmatory oral fluid drug test specimen materials and methods, processes for review by a Medical Review Officer (MRO), and requirements for federal agency actions.

The OFMG provide flexibility for federal agency workplace drug testing programs to address testing needs and to revise the requirement to collect only a urine specimen, which has existed since the Guidelines were first published in 1988. The scientific basis for the use of oral fluid as an alternative specimen for drug testing has now been broadly established, and the advances in the use of oral fluid in detecting drugs have made it possible for this alternative specimen to be used in federal programs with the same level of accuracy as urine specimens. For example, oral fluid collection devices and procedures that protect against biohazards and tampering, maintain the stability of specimen materials, and provide sufficient oral fluid for testing have been developed. Additionally, specimen volume is also much lower, saving time in collection and transport cost. Developments in analytical technologies have provided efficient and cost-effective methods with the analytical sensitivity and accuracy required for testing oral fluid specimens. Therefore, the OFMG provide the same scientific and forensic supportability of drug test results as the Mandatory Guidelines for Federal Workplace Drug Testing Programs using Urine. Federal agencies, MROs, and regulated industries using the OFMG will continue to adhere to all other federal standards established for workplace drug testing programs.

 

   

The Department of Transportation (DOT) has issued notice of proposed rulemaking (NPRM) to revise part 40 of title 49 of the Code of Federal Regulations (Part 40), “Procedures for Transportation Workplace Drug and Alcohol Testing Programs” to add the oral fluid testing procedures to the existing urine drug testing procedures for safety-sensitive transportation employees subject to drug testing under Part 40 (hereinafter referred to as “employees”). This action is based on the Department of Health and Human Services' (HHS) establishment of the Mandatory Guidelines for Federal Workplace Drug Testing Programs using Oral Fluid (OFMG) for Federal workplace drug testing programs. HHS determined that oral fluid testing conducted in accordance with the OFMG provides “the same scientific and forensic supportability of drug test results as the Mandatory Guidelines for Federal Workplace Drug Testing Programs using Urine . . . .” (84 FR 57554). The OFMG final rule was published on October 25, 2019, and became effective January 1, 2020.

In addition to adding oral fluid as a drug testing method and harmonizing with pertinent OFMG sections, we also propose to clarify certain Part 40 provisions that cover urine drug testing procedures; to remove provisions that no longer are necessary; to add clarifying language to other provisions such as updated definitions and web links, as appropriate; and to update provisions to reflect issues that have arisen in recent practice.
